Report Shows that PICS is in TROUBLE
The FBI has invested enormous resources into
efficiently conducting the NICS instant firearms background checks. A legislative study released Wednesday from
the PA Legislative Budget and Finance
Committee (look under “what’s new” on this website) said Pennsylvania's
system of instant background checks for gun buyers could go into the red in
about a year without funding changes AS WE PREDICTED IT WOULD WHEN PROPOSED AND
ENACTED INTO LAW.
Firearms dealers and county sheriffs lodged
529,000 calls in 2004 to Pennsylvania's Instant Check System, which is run by
the state police. Those calls concerned the sale or transfer of 393,000
firearms and 107,000 license-to-carry permits but do not account for other uses
of the system by law enforcement.
Historically,
about two-thirds of the system's funding has come from the general fund. The
system also collects a $2 instant-check
fee and a $3 surcharge from the sale of firearms.
This is annual report that is required as part
of language adopted in the revision to the Uniform Firearms Act (Act 17 &
66). Under this legislation Pennsylvania agreed to become a Point of Contact
(POC) state for the Brady Instant Check System and mandated that Pennsylvania
taxpayers pay millions of dollars for the Pennsylvania State Police to conduct
background checks on all gun purchases through an FFL dealer when purchasing
firearms. The interesting thing here is
that the Federal Government will do these checks for free.
The members of the PA Legislative Budget and Finance
Committee are, on the Senate side; Robert M. Tomlinson-Chairman (Bucks),
Gerald J. Lavalle-Vice Chair (Beaver), Jay Costa, Jr.(Allegheny), Charles
Lemmond (Luzerne), Robert C. Wonderling (Montgomery), and John Wozniak
(Cambria), On the House side the
members are Ron Raymond, Secretary (Deleware), Frank Pistella-Treasurer
(Allegheny), Anthony M. Deluca (Allegheny), Robert Godshall (Montgomery), David
Levdansky (Allegheny) and Mark Mustio Allegheny).
According to this report it costs at least
$4.2 million annually to fund the program, and the Firearms Record Check Fund
had a $4.4 million reserve as of June 2005.
Further, the report said that without general fund money, which is now
being eliminated by a decision from the Governor’s budget office, the $2
instant-check fee would have to be increased to at least $8.75. This amount would
not pay for proposed computer upgrades even though it would be an
approximately 500% increase in costs to gun owners.

affairs is demonstrated by their latest statement from the 02/11/2006 ILA/Alert

Please write Governor Rendell and
insist that the fee be kept reasonable so that persons of limited means are not
effectively deprived of the constitutional right to "Keep and Bear
Arms." Since the Commonwealth requires persons to obtain a license to
carry a concealed firearm, the general fund should bear the majority of the

Apparently “some” are comfortable with the
prospects of an ever increasing tax on our Constitutional Rights. WE ARE NOT!
It
is time to end the Pennsylvania Instant Check System. Since 2000, four states have opted to make
firearms dealers contact the National Instant Criminal Background Check System
directly: Arizona, Indiana, Georgia and Vermont. In addition the vast majority of other states utilize this same
approach to background checks with out any problems and it's worked very
smoothly and there are no "check fees" at all OR “Registration of
Law Abiding Gun Owners.
PA Legislature Considering
CCW & Hunting Language
Members of the legislature are considering ACSL/PSA/PFSC language to remove the prohibition on carrying a concealed firearm while involved in any activity govern by Title 34. The importance of this legislation has been dramatically increased with the recent tragic incidents were hunters have been attacked and in some cases even killed while hunting. There are also many examples were hunters have been put at risk by wildlife while hunting as well.
It is and always has been our position, that sportsmen should not be put at risk by public policy that is based on groundless fears and prejudice. It is also the height of hypocrisy for bureaucrats to demand that you surrender your constitutional rights for any activity regulated or overseen by the government.
Title 34 Section 2525
Possession of firearm for protection of self or others.
(a) General Rule. It shall be lawful for a law enforcement officer or any person who possesses a License to Carry a Firearm that is valid under Title 18 Sec 6109 to be in possession of a firearm (loaded or unloaded) while engaged in any activity regulated by Title 34. This provision shall supersede any prohibition on the possession of firearms or ammunition contained in any other section or subsection of Title 34. This provision shall not permit the hunting or harvesting of any wildlife with a firearm or ammunition not otherwise permitted by Title 34.
(b) Definitions
(1) "Firearm" as defined in Title 18 Sec 6102.
(2) "Law Enforcement Officer" as defined in Title 18 Sec 6102.
As you can see from the language above this will merely authorize possession of a concealed carry firearm and does not overruled Title 34 controls on use of firearms for hunting activities and neither does the rule use of force laws when defending oneself against the threat. This language will also empower law enforcement to carry a firearm while they are hunting as well since the current status quo is that everyone who is hunting is disarmed except for approved firearms.

to Hold Landmark Press Conference in Harrisburg on March
14th
Plans are progressing swiftly for gun owners to descend on Harrisburg in support of Rep. Metcalf and Senator Pippy who are introducing landmark legislation to end the illegal registration of Firearms Owners.
Speakers are being lined up to address the many issues remaining of consequence to Pennsylvania gun owners such as ending the duty to retreat law, ending the ban on carrying a concealed firearm in state parks, etc. For too long Pennsylvania gun owners have tolerated the introduction of and deliberation on so-called reasonable gun control measures that place us all risk.
This is a perfect opportunity for all gun owners and sportsmen and women who feel that the legislature has not heard the concerns to make their voices heard. A good turnout of gun owners and sportsmen at this event will be of immeasurable benefit for years to come. Buses are being arranged that will leave from the Pittsburgh area the morning of the rally and return the evening of the same day. Congresswoman Hart Holds
Sportsmen’s Caucus
On January 26th Congresswoman Melissa Hart held another 4th Congressional District Sportsmen’s Caucus to discuss federal issues related to gun ownership and sportsmen’s issues at the Lawrence County Sportsmen’s Association Club. Ironically this club was in an unfinished state due to the forced relocation under Eminent Domain orders to move. As would be expected this was one of the issues discussed.
Senator Santorum Introduces
the Sportsmen’s Privacy Protection Act
Washington, D.C. - U.S. Senator Rick Santorum (R-PA), Chairman of the Senate Republican Conference, introduced S. 2249, the Sportsmen's Privacy Protection Act, which would repeal the federal mandate that requires states to collect Social Security numbers for recreational licenses.
“I have heard from a lot of hunters and sportsmen’s groups about their legitimate concerns in giving their Social Security number when applying for a hunting license because the numbers are rarely protected as they should be,” said Senator Santorum. “In Pennsylvania and many other states, recreational licenses remain in a paper book often with multiple entries on a page. In my view, there are significant privacy concerns to disclosing Social Security numbers when outdoor enthusiasts purchase their hunting, fishing or recreational licenses.”
“This important legislation restores the privacy rights of recreational hunters and fishermen, while maintaining an effective system of child support enforcement,” said Senator Santorum. “I urge my colleagues to consider cosponsoring this legislation that restores the privacy rights of recreational hunters and fishermen.”
CANADA'S GUN REGISTRATION
FAILURE:
VIOLENT CRIME RATE DOUBLE
THAT OF U.S.
Canada's billion-dollar taxpayer nightmare – the national
gun registration scheme – has proven itself an abysmal failure, as that
country's violent crime rates are double those reported in the United States.
When one looks at violent crime rates per 100,000 population in both countries,
using the most recent available data ever since Canada started this ridiculous
and costly program, violent crime has gone up dramatically, at the same time
that crime in the United States has declined. Yet, there are people in the
states who think Canada's gun legislation should be the model for America.
In comparing the data it becomes apparent that the violent crime rate in the
United States was 475 per 100,000 population, while up north, there were 963
violent crimes per 100,000 population. The figure for sexual assault in Canada
per 100,000 population is more than double that of the United States, 74 as
opposed to 32.1, and the assault rate in Canada is also more than twice that of
the states, 746 to our 295 for the population rate.
In the United States one of the prime factors in actually contributing to a
reduction in our overall crime rate is that we've got 38 states with
shall-issue, right-to-carry concealed handgun laws. While Canada has severely
restricted its citizens' gun rights, our citizens have been empowered against
criminals by passage of these laws. The disparity in crime rates between the
two countries says it all about how well gun registration works to stop crime,
as opposed to actually carrying guns to deter criminals, and fight back if
necessary."
A Jan. 3 story in Canada's National Post by writer David Frum confirms these
findings where Frum wrote, "Canada's overall crime rate is now 50% higher
than the crime rate in the United States." Later, Frum added: "Gun
registries and gun bans…do not work."
Instead of promising to ban legally owned handguns in Canada, Prime Minister
Paul Martin should be urging citizens to arm themselves. He should encourage
Parliament to scrap gun registration and replace it with a gun ownership and
training program."
Since going on the warpath against guns, Canada's Liberals have presided over
the sharpest rise in violent crime in the nation's history. There are more
rapes, more robberies and more murders. If that tells Canadian citizens
anything at all, it's that Paul Martin and his Liberals have literally been
‘dead wrong' on guns.

COLLEGES FOCUS OF GUN BILL . . . A bill being considered by the Virginia House of Delegates is aimed at protecting the rights of college students who have a concealed handgun permit, reports The Roanoke Times. The bill would prohibit universities from having “the authority to establish rules or regulations limiting or abridging the ability of a student with a valid concealed handgun permit from lawfully carrying a concealed handgun.” The bill—HB 1572—includes exceptions for storage in college dormitories, military training programs and athletic events.
BLOOMBERG SAYS HE’LL SUE OUT-OF-STATE DEALERS . . .
New York City Mayor Michael Bloomberg and Boston Mayor Thomas Menino have
formed an anti-gun crime alliance, the pair announced Thursday. The two mayors
say they will campaign
nationally in an anti-gun pursuit and will recruit other mayors from around
the country to join them.
In his State
of the City Address, Bloomberg said he plans to “reach across state lines”
in his own city's effort to reduce gun crime. He issued a warning to firearms
retailers, saying, “This year, we are going to launch lawsuits against these
irresponsible dealers, and we are going to hold them accountable for the
terrible damage their guns cause.”
CRIMINALS KILL, NOT GUNS . . . Though Boston’s mayor was quick to blame guns for his city’s violent crime problem, New Hampshire’s Union-Leader pointed out last week that a rise in the city's murder rate can be attributed to more criminals in the city. “Last year Boston Mayor Tom Menino blamed an influx of guns from northern New England for the city's spiking murder rate. But an analysis by The Boston Globe last week found a more plausible culprit. A rise in young men. Typically, cities that see large increases in their population of young males also see large increases in crime. Boston was no exception,” the Union-Leader explained. “If Boston officials don't want a repeat of 2005, they'd do well to turn their resources toward finding and locking up gang members and drug dealers rather than changing gun laws in New Hampshire, Maine and Vermont.”
PROVOCATIVE ARTICLES FOR SHOOTERS, HUNTERS . . . "Why Gun Bans Don't Work…and What to Do" is an excellent article by Dr. James Swann, posted on ESPN Outdoors Web site, that provides facts and suggestions for becoming pro-active in the gun debate. "The End of Hunting," by Christina Larsen, appearing in the Washington Monthly, clearly spells out how important creating access is for the hunting heritage to survive. "Hunting for Reasons More Elusive Every Year," in the Oregonian, mourns declining hunter numbers and asks, if not hunters, then who will pay the costs of preserving habitat and managing fish and wildlife.
TEXAS CONCEALED CARRY LAW IS 10 YEARS OLD . . . The anarchy that was predicted by anti-gun interests in 1996 when the Texas Concealed Gun Law took effect has been disproved in practice, and the facts presented in an "Opinion" article by State Sen. Jerry Patterson demonstrate quite clearly why Texans are safer now than they were before the law was enacted.
ILLINOIS GUN OWNERS GET RELIEF . . . The burdensome Illinois Firearm Owner Identification Card requirement for state gun owners had gotten bogged down in a 50-day backlog, causing some gun owners to involuntarily be in violation of state law. The Illinois State Rifle Association called for an investigation into the delays, and Gov. Rod Blagojevich, following widespread complaints, announced last week the state would immediately hire part-time workers in an attempt to eliminate the backlog.
CANADIANS BLAME JUDGES FOR GUN VIOLENCE . . . Following the Dec. 26 shooting of a 15-year-old girl, Toronto residents overwhelmingly indicated that lax judges are a “major factor” spurring gun violence. One of the suspects charged in that killing of Jane Creba in a shooting that wounded six other people was out on parole at the time of the incident. Some 76 percent of respondents to the Ipsos Reid survey, conducted on behalf of the National Post and Global News, believe that lenient judges are allowing gun crime to flourish in Canada’s cities. “People are really wondering what these judges are doing,” said Darrel Bricker, president of Ipsos Reid. “They’re [the respondents] are about getting tough on crime and increasing sentences.”

Bill Would Allow Guns In Car Trunks
Firearms owners would be permitted to carry unloaded guns in their trunks, even if they don’t have a hunting license, under legislation under consideration in the state House. Rep. Experts Blame Cop Show For Educating Criminals
When Tammy Klein began investigating crime scenes eight years ago, it was virtually unheard of for a killer to use bleach to clean up a bloody mess.
