Washington D.C. City Councilman Marion Barry’s become the latest victim of violent crime.  Barry was in his Southeast apartment this week when he was robbed at gunpoint by a group of young men.  They entered his apartment, held a gun to his head, and took off with his wallet, credit cards, and cash.  Barry had given the teens a few dollars earlier in the evening after they helped bring in some of his groceries.  The former mayor describes the incident as “traumatic”.  I’d describe it as common.

This is life in “gun free” Washington, D.C.  No one is safe.  Marion Barry’s a victim of a home invasion.  Supreme Court Justice David Souter was assaulted while jogging last year.  Teresa Heinz was mugged outside her Georgetown home.  Wanda Alston, the head of the mayor’s Office of Lesbian, Gay, Bisexual & Transgender Affairs was murdered in a home invasion robbery.  You are not safe in Washington, D.C.  No one is. 

It doesn’t have to be this way, of course.  Thirty years ago, our nation’s capitol was in the midst of a crime wave.  The city council responded by banning handguns and requiring shotguns and rifles to be kept unloaded, dismantled, and locked away.  The law abiding residents of Washington, D.C. had been disarmed, and the criminals took notice.  Violent crime dipped slightly in the two years following the ban, although the murder rate actually continued to climb.  By 1979, however, the violent crime rate was back above 1976 levels, and it has remained so ever since. 

 

In the past two years, the U.S. House has passed the D.C. Personal Protection Act, which would once again allow law abiding citizens to protect themselves with a firearm in their own home.  The bill has been vilified by members of the D.C. City Council and Delegate Eleanor Holmes Norton, who said the intent of the measure was to “get more children killed”.  At least three children died from shootings in “gun free D.C.” in 2005.  None died from shootings in nearby Fairfax County, where Virginia’s laws allow not only possession of firearms, but concealed carry as well.  I’m not blaming D.C.’s firearms prohibition for the deaths of the three children, but it’s pretty clear that the laws aren’t effective in stopping criminals from arming themselves illegally. 

 What does stop a criminal?  Evidence suggests even more than increased police patrols, the fear of an armed citizenry makes a criminal have second thoughts.  A number of studies dating back to the 1980’s indicate a majority of criminals say they will not engage in a criminal act against someone they believe is armed.  But who’s armed in Washington, D.C.?  Only the criminals and the police.  There’s a vast unarmed populace to take advantage of, and no one is safe.  Not even the former mayor.

 

Lies, Damned Lies, and Statistics

Do an Internet search on "workplace violence” or “guns in the workplace" and you will find dozens of sites sponsored by corporate lawyers, security ­firms, social and health researchers, and gun control organizations, explaining how important it is for companies to have a `no guns' policy.

They will almost all present, similar statistics such as you are: five times more likely to be shot, in a business that doesn't ban guns; there were 164 work­ place -shootings between 1994 and, 2003; the number of workplace, shoot­ings nearly doubled (25 to 45) between 2002 and 2003; and that the number of resulting deaths More than doubled (33 to 69), along with a myriad of other sta­tistics detailing the carnage.

Seeing these same statistics repeated over and over again, I dug a little deeper and found that most of the statistics were taken from , a 2004 "study" conducted Handgun-Free America, a non-profit organization dedicated to the ban of private handgun ownership in the U.S.” (Their Description)

All indications are that this “organization”, founded in 2002 and silent since early 2004, never really was an organization and that it never found the financial support it needed to actually become one.

The “study”, titled “Terror Nine to Five”, consisted of LexisNexis and Google News searches for stories containing phrases such as “workplace shooting” and “disgruntled employee,” the results of which were compiled as statistics.

With such careful and scientific methodology, something as simple as a slight change in the search terms used by the “researchers” or the vernacular of reporters could easily skew the results dramatically.

The truly worrisome aspect of this “research” is that even though it was generated by an admittedly biased source and is clearly seriously flawed in its methodology, it is the single most widely quoted “study” on the subject of workplace shootings and it is being repeated as gospel by attorneys, human resources experts, and security professionals.

The “five times more likely” quote comes from a phone survey of “hundreds of businesses” in North Carolina conducted by researchers at the University of North Carolina at Chapel Hill. I have yet to find the details of this study but what I do know about it suggest that the conclusion is a statement of the author’s bias rather than a meaningful statistical result.

A comparable conclusion would be to state that one is five times more likely to be in a head-on collision when driving a car equipped with airbags than when driving a car without airbags.

The implication being that airbags cause head-on collisions.  This is of course ridiculous.  The truth is that most cars on the road today are equipped with airbags and therefore most accidents-head-on or otherwise-involve airbag equipped cars.

In the case of workplace shootings in North Carolina, the majority of businesses in the state do not ban guns so of course most shootings are going to occur in businesses that do not have a ban.

Neither of these “studies” touched on the fact that an employee is many, many times more likely to be shot in a robbery at work than by a disgruntled fellow employee.

There is no question that employers need to address issues of workplace violence.  But they need to take action based on facts, not flawed and biased research.  It is clear that the “experts” currently are using seriously flawed information from which they are drawing erroneous conclusions and recommendations for their employers and clients.  While these “experts” can be excused to some extent as there is little quality research available, they must be held to account for the damage they are doing to workers and businesses with their slipshod approach.

Even very reputable and respected organizations like ASIS International, the top industrial security association in the country, have been suckered in by this anti-gun snake-oil and are repeating the conclusions of these biased “studies”.

It is incumbent upon the firearms industry, the gun-lobby, and the pro-gun academia to counter these trumped-up studies with solid well-founded, peer-reviewed research.

 

It is likewise incumbent upon members of the legal profession and professional associations like ASIS to point out to their peers the folly of accepting and repeating such biased hogwash as Handgun-Free America has put out.

As a self-avowed gun-rights extremist, I am willing to concede the fact that one is more likely to be shot in an environment that includes guns.  What I am not willing to concede is that a sign or a policy is going to make an environment gun-free.  Since someone inclined to shoot me is not likely to be inclined to pay attention to a sign or a policy barring guns, I’d just as soon take down the sign, keep my gun, and take my chances-just like every security expert I’ve ever met.

Retired Chicago Cops Get Hosed By City Leaders

Gun rights activists in Chicago, IL, and elsewhere might be tempted to chant "wel­come to the party" as retired Windy City police officers and the Fraternal Order of Police are angry that the city will not cer­tify the retirees to continue packing pis­tols under the auspices of the federal Law Enforcement Officers Safety Act of 2004.

Congress passed the law two years ago as something of a homeland security mea­sure, reasoning that retired cops have training, and they should also have the means to defend themselves against crimi­nals they may have put behind bars dur­ing their careers.

While many gun rights activists sup­ported the measure, with the expectation that police would subsequently support measures to expand concealed carry by private citizens nationwide-something that has yet to happen-others were not so eager to allow retired police what they felt was a "perk."

Either way, retired Chicago cops won't be enjoying any benefit from the federal law. According to The Chicago Sun-Times, the city is balking at allowing its retired officers to carry over fears of continued li­ability. The federal act mandates that re­tired cops must complete refresher train­ing. This is a legal speed bump that has slowed implementation of the new law in many jurisdictions.

Chicago carries its opposition one step farther, the newspaper said by complaining that there is no national database of retired peace officers who are allowed to go armed. Police Supt. Phil Cline is also hedging that the law does not define how departments should determine a retired officer's "standing," the newspaper re­ported.

There are reportedly about 9,000 retired Chicago police officers who might qualify to carry a gun, the newspaper estimated.

Ironically, retired officers from other agencies, even other states, apparently will be allowed to carry in Chicago, pro­vided they have been certified by their former departments.  Mark Donahue, president of the Chicago Fraternal Order of Police complained, "They have no right to do this." Tackled, Disarmed by Cops In New Orleans, Woman Sues

A New Orleans woman, who wag roughly tackled and disarmed by California Highway Patrol (CHP) officers who were in the Cres­cent City to help restore order following Hur­ricane Katrina, has filed a lawsuit against the states of Louisiana and California, and their respective state police agencies.

Patricia Konie, 58, who had told offic­ers she did not want to evacuate her mod­est New Orleans home and who was body slammed by at least two lawmen identi­fied as CHP troopers as television cameras rolled, suffered injuries that required sur­gery in mid-December, according to her attorney, Ashton O'Dwyer.

Konie told Gun Week that her physician was "certain" this was an injury that re­sulted from her visibly rough treatment when officers, under orders to disarm all citi­zens and evacuate them, took her down. The 1905-vintage .32-caliber Colt revolver that was taken from Konie has never been re­turned, and its whereabouts are not known.

The Second Amendment Foundation and National Rifle Association joined in a law­suit against the city of New Orleans and sur­rounding parishes to bring a halt to the con­fiscations. A court issued a temporary re­straining order and the gun groups are still working to achieve a permanent court order. Konie is just one of several New Orleans resi­dents who were disarmed after the hurricane. Her attorney was also disarmed.

Konie's injury was described as a "dis­placed comminuted fracture of the left humerus," which is the long bone in the upper arm. Her surgery was done Dec. 12.

The complaint, filed in the US District Court for the Eastern District of Louisi­ana, says that the incident, which' occurred Sept. 8, was a "violation of federal and state law." She contends that CHP offic­ers, who were accompanied by at least one Louisiana state trooper, "wrongfully tres­passed" on her property and committed assault and battery, false imprisonment, intentional infliction of emotional distress and confiscated her revolver.

The incident was caught on film by a news crew from KTVU in San Francisco, which was accompanying the CHP detach­ment. The segment clearly shows Konie telling the officers she does not want them in her home. Moments later, she was tack­led, disarmed and taken from the house, her arm gripped by an officer, and put aboard a truck for evacuation.

According to court documents, Konie was evacuated to South Carolina, where she remained until returning to her home on Oct. 13.

The lawsuit claims that Konie's consti­tutional rights under the Second, Fourth and Fourteenth amendments were violated.

Surprisingly, the lawsuit does not name the city of New Orleans or Mayor Ray Nagin as defendants. O'Dwyer told Gun Week this is because no city police were involved in the raid on Konie's home.

O'Dwyer said he would send a copy of the KTVU news clip to Gov. Arnold Schwarzenegger and Louisiana Gov. Kathleen Blanco.

"We went into Iraq and we didn't confis­cate weapons from the Iraqis, who still possess AK47s and RPGs," O'Dwyer said.

O'Dwyer is seeking damages on Konie's behalf for criminal trespass on her prop­erty, insisting that the officers had no right to enter her home or confiscate her fire­arm. He said the case probably will not come to trial for at least several months. The New GUN WEEK, January 1, 2006

 

Dance Contest Slaying

From the "Momma Tried" file comes the truly strange story about a Philadelphia, PA, mother who has been charged in the slaying of a man whose stepson bumped her son during a street dance contest Nov. 15.

According to Associated Press and The Philadelphia Daily News, 39-year-old Patricia Hayward has been charged with murder in the shooting death of Donald Clyburn, 41, in the city's Kensington neighborhood. Clyburn's stepson, identified as Alex Ledino, ap­parently struck Hayward's kid with his elbow during the contest, but quickly apologized, insisting it was an accident.

That evidently wasn't enough to prevent Hayward from later showing up at Ledino's home, where she got into an argument with Clyburn and capped him in front of his wife, and Ledinds mother, Angela Clyburn. Hayward surrendered to the police later at the office of her attorney. The New GUN WEEK, January 1, 2006

 

Robber Living on FEMA

Another bizarre example of "your tax money at work" comes out of Stockbridge, GA, where, according to The Atlanta Journal-Con­stitution, Ronnell Middlebrooks, has ratted himself out for armed robberies committed in Georgia's Clayton and Henry counties.

Turns out Middlebrooks had been living at the Best Western motel in Stockbridge, courtesy of the Federal Emergency Manage­ment Agency, in a room that had been rented to a New Orleans man through a FEMA housing voucher. You guessed it, that man apparently had been displaced by Hurricane Katrina, but the cops say Middlebrooks was not a hurricane evacuee.

It gets better. Middlebrooks was apparently an accomplice of two men identified as Deonte Duvall Gay and Cameron Dyonn McGhee, both of whom were residing in a nearby apartment com­plex. They also reportedly confessed to participating in "multiple armed robberies" of motels and restaurants in the Stockbridge area in early November.

The newspaper didn't say where these guys originally came from, but it's a safe bet that they won't be going back for quite a while. The New GUN WEEK, January 1, 2006

 

Five WV Deer Commit Suicide

Deer hunters who claim that there are not as many whitetails as there used to be might find this story enlightening.

Either they misjudged the distance or they couldn't take the traf­fic. For reasons that mystify authorities, five deer that made their way onto the top of a five-story parking garage in Ranson, WV, suddenly leaped to their deaths on Dec. 4.

Police Cpl. Steve Cox found the does' bodies on a service road to the Charles Town Races & Slots, next to a security van they'd narrowly missed.

"They took the plunge," he said. "It was just absolutely weird." A woman called police when she saw the deer falling, and Cox said he found scratches and animal hair on the fifth floor, indicat­ing that's where they had been.

It's unclear how the deer got into the garage, but Cox said they may have become frightened after getting trapped. Cars moving through the garage may have spooked them, he said.

Or they could have been fooled by trees that can be seen from the top of the garage, mistakenly thinking they were close to home. The carcasses were given to passers-by for butchering. The New GUN WEEK, January 1, 2006

 

Cop Shoots Self Upholstering

A 21-year-veteran Newark, NJ, police officer was in fair condi­tion on Dec. 9 at a New Brunswick hospital, where he was taken after accidentally shooting himself in the stomach when he tried to remove his gun from its holster at his Edison apartment, ac­cording to The Star-Ledger of Newark.

Israel Segarra, 52, told police he was in his apartment around 7:20 p.m. the ,previous day when he struggled to remove his 9mm duty sidearm that was jammed in his holster, and the gun discharged.

Segarra ran to a neighbor's apartment and banged on the door for help, said Edison police Officer Robert Dudash. The neighbor came to the door and tried to assist Segarra and called township police.

Police found Segarra's gun still in the holster in the bedroom of his apartment, and a shell casing was partially ejected in the weapon, Dudash said.

"Although the incident appears to be an accident, our Internal Affairs investigators are thoroughly reviewing the incident to de­termine exactly what happened and insure that the officer was in compliance with the department's rules and regulations," Newark Police Director Anthony Ambrose said. Least It Wasn't over Donuts

From the "Only Cops Should Have Guns" file comes the story about an argument between two cops, one a male and his female partner, whose debate over a soft drink went way over the line.

According to The Detroit Free Press, before it was over, he had zapped her with a Taser stun gun, and she wasn't smiling. Fired from his job was Patrolman Ronald Dupuis, 32, who also faces a charge of assault. His partner, Prema Graham, apparently was not seriously injured.

According to the published report, Dupuis was in the passenger seat and Graham was at the wheel when he got thirsty. Dupuis demanded that Graham stop at a convenience store so he could purchase a soda pop, but she had other plans, and headed back for the police station. That's when they began struggling over the steer­ing wheel, and during that physical interchange, Dupuis gave Gra­ham a shot in the leg with the Taser. The New GUN WEEK, January 1, 2006

2005/12/24 PGW worker shoots teen robber

A Philadelphia Gas Works field worker shot and wounded one of two teenagers who held him up at gunpoint in Southwest Philadelphia yesterday, police said.

PGW spokesman Doug Oliver said company policy prohibits employees from having "unauthorized weapons" at any PGW work area.  While Oliver said it appears the employee violated the policy, officials don't plan to address that issue right away.

2005/12/29 NRA Lawsuit Delays Ban

San Francisco will delay enforcement of its ban on gun and ammunition sales until March 1 while a judge considers a National Rifle Association lawsuit challenging the measure. NRA plans to file suit in Superior Court December 29, arguing that the new city ordinance conflicts with state law.

2005/12/27 Gun-loving' politicians need to be straight shooters

Our first item is an article from the Boston Globe newspaper published on December 17 that says the Democratic Party is “rethinking its approach to the gun debate to improve the chances of its candidates in the western states.” Apparently it has finally dawned on the national Democratic leadership that people who own firearms are not deranged sadistic rednecks but instead, ordinary American citizens who vote religiously.
